      TO THE UNITED STATES ATTORNEY, PLEASE TAKE NOTICE that at 9:00 a.m. on April 1, 2002 or as soon thereafter as the matter can be heard, in Courtroom 6 of this court, located at 280 South 1st Street, San Jose, California 95113, defendant Elcomsoft Company, Ltd., (“Elcomsoft”) will move this court for an order dismissing the indictment brought against it on the grounds that it violates due process under the Fifth Amendment of the Constitution of the United States.

 


      Said motion is based on this Notice, a Memorandum of Law in Support of Motion, the Declarations of Alexander Katalov and Joseph M. Burton, the files and records of the case, and such other argument as may be offered at the time of the motion.
