It is a list of the works the CoS allege were infringed by Dennis on ars. I've been checking the Library of Congress Copyright History Monographs File (COHM) database to identify the works cited in Exhibit B. So far, I've only been able to identify 3 or the cited copyright registrations. Copyright registration number TX-2-238-613 is "The Organization Executive Course HCO Division 1," by L. Ron Hubbard. It was originally registered in 1975, and again after additional text, abridgement, and editing on 5 Nov 1987. This is the copyrighted work which the CoS identifies in Exhibit B as HOC PL 23, ETHICS, SUPPRESSIVE ACTS, SUPPRESSIVE ACTS [sic], SUPPRESSION OF SCIENTOLOGY AND SCIENTOLOGISTS, THE FAIR GAME LAW. I'm guessing that HOC PL 23 is actually one one item in a much larger compilation (important in determining fair use). Copyright registration number TX-2-238-614 is "The Organization Executive Staff Basic Volume 0," by L. Ron Hubbard, originally copyrighted 1975, copyrighted again 5 Nov 1987. The CoS charges that Dennis violated this copyright in number 6 and 7 of Exhibit B, HOC B22, ALTER-IS AND DEGRADED BEINGS, and HOC PL 1, STAFF MEMBER REPORTS. Again the 2 documents cited in Exhibit B appear to be only a portion of a much larger work. Copyright registration number TX-2-808-858 is "Psych Treatment Repair: Auditor Course," by L. Ron Hubbard, published 20 Feb 1990, registered 20 Apr 1990. This is the publication from which no 10 on Exhibit B, HCOB 6, THE CAUSE OF CRIME, apparently comes. In each case, it appears that the documents cited by the CoS attorneys come from larger copyrighted works. This is important as the larger works are copyrighted, not the individual documents. In fair use determinations, the amount of material quoted is definitely an important consideration. Librarians generally interpret fair use photocopying to include up to one chapter (or 30 pages) of a book or one article from one issue of a magazine. I don't know the size of the copyrighted CoS works, but I would doubt that anyone would consider the ars excerpts to go beyond fair use. I anyone more adept at database searching would like to try his hand at identifying the remaining copyright registrations listed in Exhibit B, the COpyright Office database is available on the Library of Congress gopher.
