I, Elizabeth McCoy, hereby declare that:

ÿ1. I am a plaintiff in the above-captioned matter and
submit this affidavit in opposition to the Motion of the
United States for Summary Judgment.

ÿ2. I am an adult resident of Dover, New Hampshire.

ÿ3. I am a student at the University of New Hampshire.

ÿ4. I was introduced to Steve Jackson Games Inc. and the
Illuminati BBS about four years ago and have been an active
user of the BBS since then. The BBS is a forum for me to
communicate and associate with other people who share my
major hobby interest in "gaming."

ÿ5. Since before the Illuminati BBS was shut down on
March 1, 1990, I have been the systems operator of the
Illuminati sub-board known as The Illuminati University. The
discussion on this board was and continues to be a humorous,
ongoing parody of a university, where the participants
assumed the roles of fictional students, faculty, and
administrators. The board is a cross between a free-form
online roleplaying game and multi-author fiction.

 6. I am also a regular user of the electronic mail
service provided by the BBS.

ÿ7. I had electronic communications stored on the
Illuminati BBS at the time it was shut down on March 1, 1990.

ÿ8. I sent electronic mail to Illuminati users with
userids Elric and Gremlyn on or about February 14, 1990, and
February 25, 1990, respectively. I never received responses
to this electronic mail.

I declare under penalty of perjury that the foregoing is
true and correct.
