Electronic Frontier Foundation Media Release: EFF Defends Shareholder Speech - Urges Court to Reverse Decision Against Message Board Speaker. San Francisco - Seeking to protect the free speech rights of an online corporate critic, the Electronic Frontier Foundation (EFF) today filed a "friend of the court" brief in a California appeals court. A lower court ruled that critic Michael Wells's speech was not protected because, as a corporate shareholder, he had a "pecuniary" interest in the publicly-traded company, Hollis-Eden Pharmaceuticals, which has sued him and 50 other defendants (many of whom have already prevailed against the company). EFF Amicus Curiae Brief in Hollis-Eden v. Wells, California Court of Appeal, 4th Appellate District, Division 1. EFF contends that the lower court erred in holding a Yahoo! message board poster liable for defamation, when others were not, simply because this poster was a shareholder of the company he was criticizing. (Feb. 27, 2002)
