ENROLLED 02/20/95 10:56:55 ORIGINAL HOUSE BILL NO. /U 0288 // ENROLLED ACT NO. 72, HOUSE OF REPRESENTATIVES FIFTY-THIRD LEGISLATURE OF THE STATE OF WYOMING AN ACT to create W.S. 9-1-306 relating to filings with the secretary of state; authorizing development of an electronic filing system; requiring adoption of rules if a system is developed; specifying requirements of system; retaining immunity; specifying effect of electronic filing; providing definitions; and providing for an effective date. Be It Enacted by the Legislature of the State of Wyoming: Section 1. W.S. 9-1-306 is created to read: 9-1-306. Electronic filing system. (a) The secretary of state may develop and implement a statewide electronic filing system to allow records and documents required to be filed in the office of the secretary of state to be filed by public agencies and private persons in accordance with rules adopted under this section. (b) If an electronic filing system is developed pursuant to subsection (a) of this section, the secretary of state shall adopt rules to implement the electronic filing system. The rules shall: (i) Establish a central data base for all records and documents filed electronically with the secretary of state; (ii) Provide procedures for entering data into a central data base; (iii) Provide security and protection of all information in the system and monitor the data base to ensure that unauthorized entry is not allowed; (iv) Require standardized information for entry into the system; (v) Prescribe a key encryption or other identification procedure for any person wishing to file records or other documents; (vi) Prescribe a procedure for certification of the electronic filings by the secretary of state; and (vii) Prescribe a procedure for converting an electronic filing to a paper copy and certifying the copies for persons requiring paper copies. (c) Any document filed electronically which meets the requirements of the rules, adopted pursuant to this section shall be considered to be lawfully filed with the secretary of state for all legal purposes. (d) The secretary of state shall not be liable for any loss or damages arising from errors in or omissions from information entered into the electronic filing system. (e) As used in this section "key encryption" means a method of verifying the authenticity and authorship of electronic communication through the use of algorithms or other codes. Section 2. This act is effective immediately upon completion of all acts necessary for a bill to become law as provided by Article 4, Section 8 of the Wyoming Constitution.
