        RICHARD J. MEISLIN, being duly sworn, deposes and says:
        1. I am editor in chief of New York Times Digital, which 
produces The New York Times on the Web (the "Web site").
        2. Attached hereto is a true and correct copy of an article 
that first appeared on April 28, 2000, and continues to be posted at 
http://wWw.nytimes.com/library/tech/00/04/cyber/cyberlaw/28law.html.
It is entitled "First Amendment Lawyer Takes on Movie Studios in 
DVD Case" and is by Carl S. Kaplan.
        3. The article appeared only on the Web site and not in 
the print version of The New York Times. It included six
hyperlinks to other Web sites related to the subject matter of the 
article. Clicking on those hyperlinks in the body of the article 
causes viewers to be sent to the bottom of the article. There 
they find a list of all of the hyperlinks in the article under 
this statement: "These sites are not part of The New York Times 
on the Web and The Times has no control over their content or 
availability." Only upon clicking one of the hyperlinks at the 
bottom of the article may interested readers access these other 
Web sites.
        4. The ability to refer readers to other Web sites that 
relate to a particular article is an integral part of the practice 
of journalism on the Web. The attached article, including its 
hyperlinks, is in our view sound and appropriate journalism.
