EFF Defeats DVD-CCA's Request for Secrecy Order
More Netizens Under Legal Attack for Publishing Software
EFF's defense team continues to fight DVD-CCA's refusal to turn over necessary discovery in preparation for trial in California. Judge Elfving refused to grant DVD-CCA's request for a broad and expansive confidentiality order over the materials it is forced to produce in its litigation. EFF also filed two motions to compel DVD-CCA to produce discovery documents and won on all points before the court. Judge Elfving granted EFF's request to speed up the litigation and to set a trial date at a December 5, 2000 conference. EFF's appeal of the issuance of the January preliminary injunction is currently pending before California's Sixth Appellate District.
DVD-CCA continues to add new defendants to its lawsuit against hundreds of Web publishers who published DeCSS computer code on their Web sites. On July 31st Copyleft.net, the maker of t-shirts that protest the impact of DVD-CCA's litigation were sued by the group for allegedly misappropriating its trade secrets on their t-shirts. DVD-CCA has also moved to add Jon Johansen the Norwegian teenager who created DeCSS as a defendant in the California suit and Derek Fawcus the individual who wrote the program css-auth. DVD-CCA has also attempted to sue Matt Pavlovich the LiVid project leader who used DeCSS to build a Linux DVD player. Pavlovich filed a motion to quash the California court's jurisdiction over him, since he lives in Texas. Pavlovich's motion is scheduled to be heard on August 28th in Judge Elfving's Court in Santa Clara County.
