Pursuant to statements made by defense counsel during argument opposing plaintiffs' pending TRO request, below ae the case citations defense counsel agreed to furnish the court.  For the court's convenience, a copy of these cases is provided to the court, but not served on parties.

1.    Bernstein v. D.O.J., 192 F.3d 1308 (9th Cir. 1999) (Computer code is protected speech, prior restraint impossible).

2.    Bernstein v. Dept. of State, 974 F. Supp. 1288 (N.D. Cal. 1997) (Computer code is protected speech).

3.    Sega v. Accolade 977 F2d 1510 (9th Cir. 1992) (Reverse engineering of computer code is lawful).
