DMCA Subpoenas
When the RIAA started suing filesharers in 2003, it tried to use a dangerous subpoena power under the Digital Millennium Copyright Act (DMCA). Without filing a lawsuit, providing any proof, or putting the subpoena before a judge's eyes, they could get the information of an Internet based on a mere allegation of infringement. In a ruling that protected privacy online, the DC Circuit Court of Appeals agreed with Verizon and EFF that the DMCA's special subpoena provisions apply to potentially infringing material stored on an ISP server, not material stored on an individual's own computer. Several other ISPs also fought back and achieved similar rulings.
