This translation will probably be revised by subsequent translators EDICT OF THE PRESIDENT OF THE RUSSIAN FEDERATION ABOUT ARRANGEMENTS FOR ENFORCING LEGAL ORDER IN THE AREA OF DEVELOPMENT, PRODUCTION, SALES AND USE OF CRYPTOGRAPHIC INSTRUMENTS, AS WELL AS RENDERING SERVICES IN INFORMATION ENCRYPTION In order to secure unconditional fulfillment of the Law of the Russian Federation "About federal bodies for government communications and information", as well as to intensify the struggle against organized crime and to enhance protection of information and telecommunication systems of the bodies of state power, Russian structures for banking and finance, enterprises and organizations I decree: 1. The Programme for creation and development of information and telecommunication system for special assignments for the benefit of bodies of state power shall have the status of Presidential programme. The Center for Presidential programmes at the Administration of the President of the Russian federation jointly with the Federal agency for government communications and information attached to the President of the Russian Federation shall arrange for finishing and implementation of the programme. 2. To forbid use by government organizations and enterprises in their information and telecommunication systems of encryption instruments, including cryptographic instruments in support of authenticity of information (electronic signature), and protected technical devices for storing, processing and transmission of information which have no certificate from the Federal agency for government communications and information attached to the President of the Russian Federation, as well as giving government contracts to enterprises, organizations using said technical and encrypting instruments having no certificate from the Federal agency for government communications and information attached to the President of the Russian Federation. 3. To advise the Central bank of the Russian federation and the Federal agency for government communications and information attached to the President of the Russian Federation to take necessary actions with respect to commercial banks evading mandatory use of protected technical instruments for storing, processing and transmission of information, having a certificate from the Federal agency for government communications and information attached to the President of the Russian Federation, in their informational interaction with subdivisions of the Central bank of the Russian Federation. 4. For improvement of informational security of the Russian Federation and intensification of the struggle against organized crime, to forbid activities of legal and physical persons related to development, production, sales and use of encryption instruments as well as protected technical devices for storing, processing and transmission of information, rendering services in information encryption, without licenses issued by the Federal agency for government communications and information attached to the President of the Russian Federation, in accordance with the Law of the Russian Federation "About federal bodies for government communications and information". 5. The State customs committee of the Russian Federation shall take actions to stop import into the territory of the Russian Federation of cryptographic instruments of foreign make without a license from the Ministry for external economic relations of the Russian Federation issued with the consent of the Federal agency for government communications and information attached to the President of the Russian Federation. 6. The federal counterintelligence service of the Russian Federation jointly with the Federal agency for government communications and information attached to the President of the Russian Federation, the State tax service of the Russian Federation and the Department of tax police of the Russian Federation shall carry out detection of legal and physical persons violating the requirements of this edict. 7. To advise the Office of the Procurator-General of the Russian Federation to intensify procurator supervision of enforcement of the Law of the Russian Federation "About federal bodies for government communications and information" regarding development, production, sales and use of cryptographic instruments as well as rendering services in information encryption in Russian Federation, subject to licensing and certification by the Federal agency for government communications and information attached to the President of the Russian Federation. 8. To establish the Federal center for protection of economic information at the Federal agency for government communications and information attached to the President of the Russian Federation (within the personnel quota for this agency) with the mission of development and implementation of manifold programs of safeguarding security of economic information of Russian structures for banking, finance and other economically significant structures. The director-general of the Federal agency for government communications and information attached to the President of the Russian Federation shall approve within 2 months the Statute of the said center. 9. This edict takes effect since the day of its publication. To ensure unconditional execution of the Law of Russian Federation "On Federal Institutions Providing Government Communications and Information" and intensifying the fighting with the organized crime and improving protection of information and telecommunication systems of the government bodies, Russian credit and financial structures, enterprises and organizations, I decree: 1. Assign the status of a president program to the Program of design and development of informational and telecommunication system of the special purpose and in the interest of the governenment bodies. The Center of President Programs of Administration of President of Russian Federation, jointly with FAPSI [former KGB operation, similar to the U.S. NSA; Federal Agency for Governmental Communication & Information, possibly headed by A.A. Soldatov, ex-head of the Coputer Center of the Kurchatov Inst., and a foudner of the Relcom network] is to make sure the program is completed and implemented. 2. Government organizations and enterprises are prohibited to use encryption means, including cryptographical means of authentication (electronic signature) and protected technical means of storage, processing and transmission of information, not certified by FAPSI in their information and telecommunication systems. Placement of goverment contracts in enterprises and organizations using said technical and cryptographical means not certified by FAPSI is also prohibited. 3. Central Bank of Russian Federation and FAPSI are recommended to take necessary actions to compel compliance of commercial banks of Russian Federation attempting to avoid mandatory use of certified by FAPSI protected technical means of storage, processing and transmission of information when they are communicating with divisions of the Central Bank. 4. In the interests of informational security of RF [Russian Federation, abbr] and intensifying the fighting against the organized crime the activity of legal and physical entities, related to development, manufacturing, implementation and use of means of encryption, and also protected means of storage, processing and transmission of information, providing services in the field of data encryption without licenses issued by FAPSI is accordance with the Law of RF "On Federal Institutions Providing Government Communications and Information" is prohibited. 5. The Government Customs Commitee of RF is to take appropriate actions on prevention of import to the territory of RF all encryption means of foreighn manufacture without an appropriate license from MVES [some foreighn trade regulatory body -- avg] issued with approval from FAPSI. 6. FSK of RF [Federal Security Commitee, ex KGB -- avg] and MVD of RF [Ministry of Interior Affairs, the police and border guard -- avg] jointly with FAPSI and Department of Tax Police of RF are to uncover legal and physical entities violating the requirements of this Decree. 7. The Prosecutor General of RF is to intensify the supervising of the compliance with the Law of RF "Federal Institutions Providing Government Communications and Information", particularly in relation to development, manufacturing, implamentation and usage of means of encryption, and also providing services in the field of data encryption in RF, subject to licensing by FAPSI. 8. Create the Federal Center of Protection of Economical Information affiliated with FAPSI (staffed out of the Agency's resources) and make this Center responsible for development and implementation of comprehensive programs on ensuring security of economical information of Russian credit and financial institutions and other economically significant structures in the country. 9.
